Artificial Intelligence and Copyright

About The Book

This book offers an in-depth analysis of the impact of artificial intelligence and more specifically generative artificial intelligence on copyright in the Democratic Republic of Congo. Using an exegetical sociological and comparative approach it highlights the limits of a legal framework inherited from the 1986 ordinance-law centered on human creation in the face of new technological realities. The study questions the notion of originality authorship and the attribution of rights when a work is produced by an autonomous algorithmic system. It explores several hypotheses in particular the identification of the designer or user or the adoption of alternative solutions based on contractual or sui generis regimes. This work demonstrates the urgent need for appropriate normative reform to reconcile technological innovation and the safeguarding of creators' rights while preserving the balance between scientific progress and the protection of the fundamental values of copyright.
