Bail in the DRC justice system

Since detention is an exception to the principle of liberty any person who has been provisionally arrested has the right to apply for provisional release on payment of a bond which may guarantee his provisional release pending the final decision of a competent court in the knowledge that the bond will be refunded to him if he is acquitted by a final decision. Thus this work starts from empirical facts observed in the Congolese jurisdiction which are different from the legal letter in force in the Democratic Republic of Congo. We can say that the comments evoked in this handbook will enable legal practitioners to be equipped to defend the interests of their clients with a proven knowledge in the matter; not only will it enable legal practitioners it goes without saying that it is also at the service of litigants who are curious to know their rights; but also scientists in the context of their research.
