Creditors of partnerships:

The concern of creditors is to recover their overdue debts from their debtors. They need mechanisms to help them achieve this goal. The study focuses on creditor protection in partnerships and aims to elucidate the status of creditor protection within partnerships. The analysis is thus made in light of the multitude of guarantees offered by partnerships as evidenced by the diversity of assets that may support the partnership''s debts. As a result the partnership''s creditors in fact benefit from a double protection but in practice many events contribute to the weakening of this protection. This new situation now calls for a different rethinking of the existing protection mechanisms in favour of these creditors.
