Discrimination on the basis of disability and health

About The Book

In the first part of this study we examined disability and health as prohibited grounds for discrimination. First of all we analyzed the social construction of disability which contrary to the medical model shifts the problem away from the individual and resituates it in the social processes related to human diversity. Furthermore we asked ourselves whether illness and inability are able to justify a dismissal or whether they constitute causes of discrimination. It does not seem that the European legislator wants to include them among the prohibited reasons for discrimination. By studying the legislation on protection against discrimination on the grounds of disability we have seen that it has provided solutions where protection against discrimination on the grounds of health status is not regulated. Then in the second part we looked at Multiple Discrimination and noted the ineffectiveness of the European legislation and most of the legislation of the EU Member States in combating it.
