EARLY DISPUTE RESOLUTION: A TACTICAL APPROACH

After prolonged course of brainstorming since February 1984 for rendering tangible assistance withthe aid of alternate dispute resolution procedure to the aggrieved party / parties exposed to lossesand injuries of diverse nature suffered during the course of execution of works / projects underworks contract I feel it apposite to suggest certain procedures to elude contractual disputes to theextent feasible and in the event such disputes are not resolved within a reasonable time compellingthe party / parties to invoke under painful necessity alternate dispute resolution procedure to suggest courseof action depending on the nature of disputes by which the procedure can be accelerated /concluded in earliest time.It is needles to mention that the course of action suggested to be followed by the respective partiesfor uninterrupted execution of any works contract and / or for minimising/ eliminating any disputeor difference during performance of contract may be different for different contracts and fordifferent factual matrix culminating to the disputes and differences between the parties.
