About The Book

The book is aimed at enabling the reader to identify and appreciate the evolution of environmental jurisprudence in India. It highlights and compares the dominant environmental adjudicatory trends from the public interest litigation phase in the 1980s to the present-day adjudication of the National Green Tribunal. In doing so the book compares the legal reasoning employed by different adjudicatory bodies nationally and internationally and seeks to contextualise and situate the present legal trends in the NGT’s adjudication within the overall framework of Indian environmental jurisprudence. The book employs the case-book method whereby the reader is exposed to the relevant portions of several landmark environmental judgments followed by notes and questions. This direct interface with case law and legal reasoning is likely to assist the reader in formulating their own legal opinion and critically analysing the case. Finally it explores the socio-enviro impact of environmental policy and adjudication.
