The Rome Statute of the International Criminal Court explicitly rejects immunity for high ranking State officials. Nevertheless Kenyatta''s and Ruto''s cases in 2013 challenged the Rome Statute and the ICC''s established practice. Thus the aim of this research is to analyse the possible impact of both the newly adopted and proposed amendments to the Rome Statute and its Rules of Procedure and Evidence; and to determine whether such amendments are not contrary to the object and purpose of the Rome Statute and international customary law.
