<p>In today's world simply having access to land labor and capital are not sufficient for a nation's prosperity. The creative process and innovative thinking are now the primary forces propelling the global economy. The welfare of a nation will almost always be directly correlated to the policies that it pursues. The most essential activity in this context is the cultivation of an individual nation's intellectual capital. An efficient framework for protecting intellectual property rights should be at the center of a country's plans for its future development. The intellectual property system is a dynamic tool for wealth creation within knowledge-based innovation-driven economies. It offers an incentive for businesses and individuals to create and innovate a fertile setting for the development of and trade in intellectual assets and a stable environment for domestic and international investments. In spite of the fact that India has fulfilled its duties under TRIPS by updating its intellectual property laws there are still certain concerns that need to be addressed. In addition there is a continuing need for pondering over the fundamental problem of intellectual property protection in order to be able to adapt to scenarios that arise as a result of global competition.</p>
