Iraq Lawyer Case File: Project Nikandros

Iraq Lawyer (www.iraqlawyer.co.uk) is a law practice headquartered in Sulaimani Iraqi Kurdistan which offers legal services across all eighteen governorates of the federal Republic of Iraq. Iraq Lawyer has been instructed by the Plaintiff (P) to prosecute international legal action against four defendants who are (or who claim to be): Mr Felix Nikandros NBGE Operations Director in Cairo (1st Defendant N->D1 ) the National Bank of Greece Egypt (2nd Defendant N->D2) in Cairo the Credit Suisse AG Bank in Cairo (N->D3) and the International Monetary Fund (IMF) headquartered in Washington DC USA (N->D4) [Sidebar Project Gertrude] for acting fraudulently or negligently or in breach of an Irrevocable Guarantee in the matter of transferring funds to the sum of $6.5 Million USD owned by Plaintiff and held in a bank account controlled by the 1st and 2nd Defendants (N->D1 - N->D2). Iraq Lawyer will file the primary action against the four Project Nikandros Defendants in the Sulaimani Courts of Enquiry for breach of Article 456 of the PENAL CODE 111 of 1969 of the Kurdistan Region of Iraq and the Republic of Iraq. The primary action is likely to result in secondary civil and/or criminal legal actions in Egypt the United Kingdom and the United States of America (USA). Iraq Lawyer initially produced this briefing paper mainly to enable law firms in Egypt UK and USA to prepare proposals for supporting the secondary legal actions in these three jurisdictions. Iraq Lawyer has now decided to publish it as a research work in order to put a dated and peer-reviewed record of Plaintiff’s case and all the associated evidence in the public domain ahead of the legal actions. Sidebar – Project Gertrude The International Monetary Fund (IMF) headquartered in Washington DC USA is also one of the defendants in a separate legal action Project Gertrude that Iraq Lawyer has been instructed by the Plaintiff to pursue. Project Gertrude will be introduced in Section 4 of this narrative.
