Domestic Violence is a serious violation of Human Rights. There has been a growing trend of domestic violence incidents in India. The Parliament in order to tackle this growing menace has in the year 2005 passed a legislation titled ‘The Protection of Women from Domestic Violence Act 2005’. The Preamble of the Act declares that it is an Act to provide for more effective protection of the rights of women guaranteed under the Constitution who are victims of violence of any kind occurring within the family. Even United Nations has been concerned with the alarming rise in the number of cases of domestic violence. United Nations Declaration on the Elimination of Violence against Women (1993) states that “Violence against women is a manifestation of historically unequal power relations between men and women which have led to domination over and discrimination against women by men and to the prevention of the full advancement of women.” The Act provides protection to any aggrieved woman and provides for a variety of reliefs including maintenance order and residence order to help the victims.
