State and Constituent Power

About The Book

The present work is the product of several reflections after the analysis of several Constitutions and the implementation of constituent processes both original and derived from the French and American Revolution in the 18th century through a brief account of the most emblematic processes of the last 50 years in Latin America such as the Spanish Transition the recent constituent process in Chile the current constituent proposal in Colombia and the numerous constitutional transformations in Venezuela. The book seeks to recall the essential principles and rules of the Rule of Law as well as the conjunction that must exist between State sovereignty constitutional supremacy and constituent power in order to approach the limits of that power and to warn about the usual political manipulations that we have observed in the last two decades in relation to these concepts that are part of constitutional law.
