International treaties are the legal instrument par excellence for international cooperation and the source par excellence of International Public Law. As such once they have been concluded they are bound to be recognized as the internal rights of their signatory states which raises the question of the application of international treaties and their pre-eminence over the internal rights of States Parties.Indeed the Constitution of the Democratic Republic of Congo of February 18 2006 as amended to date enshrines the application of international treaties and their supremacy over domestic laws.As part of this study we have reviewed the conditions for the application of international treaties and their primacy over domestic laws while raising a number of related questions and making a number of recommendations to the legislator.
