The members of the Military Forces in the performance of their duty are involved in the commission of illegal acts and acts of corruption which leads to the corresponding criminal actions being brought against them either by the ordinary justice system or by the military justice system and as defendants they have the right to the development of a criminal process with the fulfillment of the guarantees and respect for their fundamental rights. Within the Colombian penal system a series of legal figures have been created in order to speed up the process and have a prompt and effective justice which is why the military and police also have the right to be accepted by these forms of negotiation and early termination of the process but it is observed that within the military penal legislation there are currently gaps in its application. This book also takes a look at the Brazilian Military Forces pointing out that there are several obstacles during the investigation and trial of their members due to the same corruption within their ranks.
