The Principle of Prohibition of Deficit

This paper aims to investigate the Principle of Prohibition of Deficit addressing its historical emergence the existence or lack of dogmatic autonomy of the principle as well as analyze the decision of the Supreme Court rendered in Direct Action of Unconstitutionality by Omission n. 26 and Mandate of Injunction n. 4.733 on the Criminalization of Homophobia using the proposal for filling the normative content of the principle formulated by Professor Jorge Reis Novais.
